Terms of Service

The terms of this agreement (“Terms of Service”) govern the relationship between you and Sacrosanct Interactive regarding your use of Imperium: Reclaimed and Sacrosanct Interactive resources (collectively hereinafter "Service").

All players of Imperium: Reclaimed are expected to abide by the Terms of Service detailed below. By creating an Imperium: Reclaimed account, by playing Imperium: Reclaimed, or by using the services on a Sacrosanct Interactive resource you consent to the terms set forth in the Terms of Service and the PrivacyPolicy. If you do not accept the terms in these documents, do not create an account, or if you have any existing accounts delete them, and cease to use Sacrosanct Interactive and Imperium: Reclaimed resources and services.

If you access our games through a third party service or use an affiliated third party service (e.g., forums), you shall comply with its terms and policies in addition to the terms and policies of Sacrosanct Interactive.

License

Subject to your agreement and continuing compliance with these Terms of Service and other Sacrosanct Interactive policies, Sacrosanct Interactive hereby grants you a personal, non-exclusive, non-transferable license to access and use Imperium: Reclaimed for personal entertainment purposes. Sacrosanct Interactive may revoke this license at any time and ban your use of Imperium: Reclaimed if at any time you violate the Terms of Service or other Sacrosanct Interactive policies.

Access

Any costs associated with and incurred by a user for equipment, software, and internet access used to access the Service are the sole responsibility of the user.

Registration

In order to establish an Imperium: Reclaimed account, a login, password, and avatar name are required. For security purposes, your login should be different from your avatar name.

You may not select as your avatar name the name of a living person (unless it is your name), a name for the purpose of fraud, or a name that violates any third party's trademark right, copyright, or other proprietary right, or which is deemed vulgar or offensive by Sacrosanct Interactive. Sacrosanct Interactive reserves the right to delete accounts, edit avatar names, or to require that a user change their avatar name for accounts which violate the Registration terms.

Sacrosanct Interactive recommends that your password be composed of letters, numbers, and special characters and is at least eight characters long. Do not use your login or avatar name as your password.

A user may choose to submit personal information to Sacrosanct Interactive. You must only enter information that you warrant is true and accurate about yourself. This information must be kept up to date by the user or deleted. Failure to provide true and accurate information may result in Sacrosanct Interactive suspending or terminating your account and refusing your current and future use of all Sacrosanct Interactive services and resources.

You are solely responsible for maintaining the confidentiality of your login information. You are responsible for anything that happens through your account, including purchases and donations, whether or not authorized by you. In the event you become aware of or reasonably suspect any breach of security, you must notify Sacrosanct Interactive.

Age Requirement

This Service is a game intended for players of age 13 or older. By agreeing to the Terms of Service, players under the age of 18 affirm that they are at least 13 years old and have received permission to play Imperium: Reclaimed from their parent or legal guardian.

Restrictions

You agree not to do any of the following prohibited actions:

1. Reproduce, distribute, publicly display, perform, translate, modify, adapt, create derivative works from, deconstruct, reverse engineer, decompile or disassemble in any manner Imperium: Reclaimed or any portion thereof, including but not limited to any character, graphic, or associated software.
2. Permit any person other than yourself access to your account.
3. Upload, post, e-mail, link to, advertise or otherwise transmit through the Service any material that (i) is unlawful, harmful, tortious, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, contains nudity, excessive violence, or is racially, ethnically or otherwise objectionable; (ii) you do not have a right to transmit under any law or contractual or fiduciary relationship; (iii) infringes any patent, trademark, trade secret, copyright, or other party's proprietary rights; (iv) is advertising, promotional material, junk mail, spam, chain letters, pyramid schemes, or other solicitations; or (v) contains software viruses, computer code, file, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment.
4. Use the Service to engage in illegal conduct.
5. Impersonate another user, administrator, or staff member of Sacrosanct Interactive.
6. Attempt to, or stalk, harass, abuse, harm, or advocate or incite stalking, harassment, abuse, or harm of another person, or group, including Sacrosanct Interactive staff or representatives.
7. Forge headers, manipulate identifiers, etc. in order to disguise the origin of any materials you or another party transmits through the Service.
8. Collect, harvest, store, or reveal personal data about another user without their express written permission.
9. Use the Service or any part thereof for performing in-game services, such as power-leveling and item collection, in exchange for payment outside the Service.
10. Interfere with or disrupt the operation of the Service. This includes but is not limited to unauthorized access of any Sacrosanct Interactive servers, networks, and accounts; modifying any files or using game hacking/altering/cheating software or tools, including scripting or macro software; attempt to disassemble the game client and/or decipher the data transmissions between the Imperium: Reclaimed client and server; use any unauthorized third-party software that accesses, intercepts, mines, or otherwise collects information from the Service or that is in transit from or to the Service; overburden, or aid or assist in the overburdening, or place an unreasonable or disproportionately large load on the Service; or institute, assist, or become involved in any type of attack, including but not limited to the distribution of a virus or denial of service attack. These actions may subject you to civil and/or criminal liability.
11. Make improper use of Sacrosanct Interactive's support services, wiki, and forums, including the submission of false abuse reports.
12. Make any automated use of the Service beyond the automation tools provided by Sacrosanct Interactive.
13. Create and/or maintain multiple accounts whose actions are coordinated to manipulate the game environment, advance your standing within the game, obtain information in a dishonest manner, or deceive other players.
14. Play Imperium: Reclaimed on any service or service that is not authorized by Sacrosanct Interactive.

Content

Sacrosanct Interactive reserves the right to monitor all content on the Service and to edit, filter, or remove content without notice. Sacrosanct Interactive makes no representations or warranties about the Service content and under no circumstances will Sacrosanct Interactive be liable in any way for any content, or for any loss or damage of any kind incurred as a result of use of any content on the Service.

User Content

“User Content” is any communications, images, sounds, and all the material, data, and information that you upload or transmit through the Service, or that other users upload or transmit, including any chat text, in game messages, forum posts, or wiki content.

Sacrosanct Interactive assumes no responsibility for the conduct of any user submitting any User Content, and assumes no responsibility or obligation to monitor, censor, or remove User Content that is inappropriate. Sacrosanct Interactive has the sole right to monitor, filter, edit, refuse, or remove any User Content.

You hereby grant Sacrosanct Interactive a perpetual and irrevocable, worldwide, fully paid-up and royalty free, non-exclusive, unlimited license to use and practice in any way now known or in the future discovered, your User Content as well as all modified and derivative works thereof.

Advertising

Sacrosanct Interactive is not responsible or liable for, does not endorse, and makes no representation or warranty about the content, products, goods, and/or services advertised on the Service. Any charges or obligations incurred by you in your dealings with these third parties are your responsibility. Linked sites are not under the control of Sacrosanct Interactive and may collect data or solicit personal information from you. Sacrosanct Interactive is not responsible for third party business practices and policies.

Privacy

These terms are also subject to the PrivacyPolicy. Any information obtained by Sacrosanct Interactive may be provided to law enforcement officials in response to subpoenas, court orders, and other legal processes. Such information may also be used to establish or exercise Sacrosanct Interactive's legal rights and to defend against legal claims. Sacrosanct Interactive reserves the right to use gathered personal information in the investigation of, in the prevention of, or to take action regarding illegal activities, suspected fraud, potential threats to the physical safety of any person, violations of the Terms of Service, or as otherwise required by law.

Updates of Service

You understand that the Service may require updates, and you acknowledge and agree that Sacrosanct Interactive may make such updates with or without notifying you. Sacrosanct Interactive makes no claims regarding the availability of the Service and has no liability for disruptions of the Service.

Ownership

Sacrosanct Interactive and its licensors shall at all times retain all right, title, and interest in and to Imperium: Reclaimed. Imperium: Reclaimed is a trademark of Sacrosanct Interactive.

Accounts

NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO THE ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF SACROSANCT INTERACTIVE. SACROSANCT INTERACTIVE RESERVES THE RIGHT TO TERMINATE ANY ACCOUNT THAT HAS BEEN INACTIVE FOR 180 DAYS.

Disclaimer of Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SACROSANCT INTERACTIVE, ITS AFFILIATES, LICENSORS AND SUBCONTRACTORS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SACROSANCT INTERACTIVE PROVIDES THE SITE, SERVICES AND GAMES (AND ANY RELATED SOFTWARE OR HARDWARE USED OR PROVIDED BY SACROSANCT INTERACTIVE IN CONNECTION THEREWITH OR ANY CONTENT INCLUDED THEREIN) “AS IS” AND ON AN “AS AVAILABLE” BASIS, AND MAKES NO WARRANTY OF PERFORMANCE OR QUALITY OR THAT THE SITE, SERVICES, OR GAMES WILL BE ERROR-FREE OR UNINTERRUPTED.

Limitations; Waivers of Liability

YOU ACKNOWLEDGE AND AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY ANY APPLICABLE LAW, THE DISCLAIMERS OF LIABILITY CONTAINED HEREIN APPLY TO ANY AND ALL DAMAGES OR INJURY WHATSOEVER CAUSED BY OR RELATED TO USE OF, OR INABILITY TO USE, THE SERVICE UNDER ANY CAUSE OR ACTION WHATSOEVER OF ANY JURISDICTION, INCLUDING, WITHOUT LIMITATION, ACTIONS FOR BREACH OF WARRANTY, BREACH OF CONTRACT OR TORT (INCLUDING NEGLIGENCE) AND THAT THE SACROSANCT INTERACTIVE PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES IN ANY WAY WHATSOEVER ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SERVICE.

YOU FURTHER SPECIFICALLY ACKNOWLEDGE THAT THE SACROSANCT INTERACTIVE PARTIES ARE NOT LIABLE, AND YOU AGREE NOT TO SEEK TO HOLD THE SACROSANCT INTERACTIVE PARTIES LIABLE, FOR THE CONDUCT OF THIRD PARTIES, INCLUDING OTHER USERS OF THE SERVICE AND OPERATORS OF EXTERNAL SITES, AND THAT THE RISK OF THE SERVICE AND EXTERNAL SITES AND OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

UNDER NO CIRCUMSTANCES WILL THE SACROSANCT INTERACTIVE PARTIES BE LIABLE TO YOU FOR MORE THAN THE AMOUNT YOU HAVE PAID SACROSANCT INTERACTIVE IN THE ONE HUNDRED AND EIGHTY (180) DAYS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT ANY SUCH CLAIM.

YOU ACKNOWLEDGE AND AGREE THAT IF YOU HAVE NOT PAID SACROSANCT INTERACTIVE ANY AMOUNTS IN THE ONE HUNDRED AND EIGHTY (180) DAYS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT ANY SUCH CLAIM, YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH SACROSANCT INTERACTIVE IS TO STOP USING THE SERVICE AND TO CANCEL YOUR ACCOUNT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THE SECTION MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify and hold harmless Sacrosanct Interactive, its affiliates, licensors and subcontractors from all liabilities, claims and expenses, including attorneys' fees, arising from or related to your breach of this Terms of Service or portion hereof, your User Content or any act or omission by you relating to the Service. Sacrosanct Interactive reserves the right to assume its own defense and/or control of any matter otherwise subject to indemnification by you hereunder. You agree that the provisions in this paragraph will survive any termination of your Account(s) or of the Service.

Termination

You may terminate your account and this agreement at any time without further obligation to Sacrosanct Interactive. Further, Sacrosanct Interactive reserves the right to terminate the Service, or any part thereof, at any time without notice and without further obligation to you. IN NO EVENT SHALL YOU BE ENTITLED TO A REFUND OF ANY FEES OR PRORATION THEREOF. UPON TERMINATION OF THIS AGREEMENT, YOUR ACCESS PRIVILEGES TO THE SERVICE WILL TERMINATE AND YOU WILL FORFEIT ANY UNUSED ACCESS TIME AND CREDITS THAT YOU PURCHASED OR RECEIVED PRIOR TO TERMINATION. A member whose account Sacrosanct Interactive has terminated may not access the Service in any manner or for any reason without Sacrosanct Interactive's express, prior, written permission. Termination of this agreement shall have no effect on any payment obligation accrued prior to the effective date of termination. The following sections shall survive termination: Disclaimer of Warranty, Limitations; Waivers of Liability, Indemnification, Termination, Amendment, Reservation of Rights, and General Provisions.

Amendment

Sacrosanct Interactive may amend the Terms of Service at its sole discretion at any time by posting a revised Terms of Service on the Service, and you agree to regularly review the Terms of Service. If any such revision is unacceptable to you, you may terminate your account and this agreement as provided in "Termination". Your continued access and use of the Service seven (7) days after posting of the revised Terms of Service shall constitute your acceptance of any updated Terms of Services and additional policies. All amended terms shall automatically be effective 30 days after they are initially posted. Except as expressly set forth herein, the Terms of Service may not otherwise be modified or amended.

Reservation of Rights

Sacrosanct Interactive hereby reserves any rights not expressly granted herein.

General Provisions

You may not sublicense, rent, sell, assign or otherwise transfer the rights or obligations granted to you in this agreement, and any such attempted transfer shall be void. If any provision of this agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and such decision shall not affect the enforceability of: (i) such provision under other circumstances, or (ii) the remaining provisions hereof under all circumstances. Sacrosanct Interactive's failure to enforce at any time any provision of this agreement shall in no way be construed to be a present or future waiver of such provision, nor in any way affect the right of any party to enforce each and every such provision thereafter. The express waiver by Sacrosanct Interactive of any provision, condition or requirement of this agreement shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement. Notwithstanding anything to the contrary, no default, delay or failure to perform on the part of Sacrosanct Interactive shall be considered a breach of this agreement if such default, delay or failure to perform is shown to be due to causes beyond Sacrosanct Interactive's reasonable control. This agreement is governed by and construed under Tennessee law without regard to its conflict of law principles, and you agree to submit to the jurisdiction of the courts located in Knox County, in the State of Tennessee, U.S.A. for the resolution of any dispute arising from or related to this agreement. In any action to enforce this agreement, the prevailing party shall be awarded its costs and fees (including reasonable attorneys' fees), including such fees and costs incurred in enforcing and collecting any judgment. All notices given by you shall be sent via e-mail to support@sacrointeract.com. Sacrosanct Interactive may give notice to you at the e-mail address you provide in the Registration. This agreement represents the entire agreement between you and Sacrosanct Interactive with respect to the subject matter referenced herein.
